Regulatory Changes
Service Agencies for Weighing and Measuring Devices (formerly
known as Device Repairman) The new laws can be found in
the Business and Professions Code Division 5, Chapter
5.5.starting with section 12531(definitions).
The law requires companies repairing devices to register
with the California Department of Food and Agriculture
and their employees must pass an examination.
The new regulations implementing this law can be found
in the California Code of Regulations, Title 4, Division
9, Chapter 4; Sections 4080
through 4088.
Summary of changes: There are several changes that
affect service agencies and their employees who repair
and place into service commercial weighing or measuring
devices.
- Each service agent must be licensed. In order to
obtain a license, you must pass a written examination.
Examinations are offered at our office by appointment,
please call 1-800- 734-9459. The fee is $35.00. Every
service agent shall be reexamined every five years.
- Standards used by service agencies to place weighing
and measuring devices into service must have a current
certificate of accuracy from a certified lab recognized
by the State of California. Standards must be permanently
and uniquely identified. Our office can certify 5-gallon
test measures.
- A service agency registration may be suspended for
the actions of its service agents.
- A service agency's authorization to place devices
into service, or to remove out-of-order notices may
be suspended by a county sealer, within his or her
county, pursuant to the notice and hearing provisions
described in the Business and Professions Code, section
12544.
- Service Agents shall identify their work on each
device by applying an adhesive tag or label in a conspicuous
location on the device. The adhesive tag or label
shall show the name, registration number, business
telephone number of the service agency, license number
of the service agent performing the work and date.
- Service agents shall replace a security seal on
any adjustment mechanism where the seal was removed
for service, repair or installation.
Service Stations, Provision of air, water and pressure
gauge
On or after January 1, 2000, every service station in
the State of California must provide water, compressed
air, and a gauge for measuring air pressure at no cost
to customers who purchase motor vehicle fuel. This new
law can be found in the California Business and Professions
Code section
13651.
Every service station in the state shall display, at
a conspicuous place on, at, or near the dispensing apparatus,
at least one clearly visible sign which shall read as
follows:
"CALIFORNIA LAW REQUIRES THIS STATION TO PROVIDE
FREE AIR AND WATER FOR AUTOMOTIVE PURPOSES TO ITS CUSOMERS
WHO PURCHASE MOTOR VEHICLE FUEL. IF YOU HAVE A COMPLAINT
NOTIFY THE STATION ATTENDENT AND OR CALL THIS TOLL-FREE
NUMBER: 1 (800) 356-7057."
This sign shall meet the requirements of Business and
Professions code sections
13473 and 13474 with regards to letter size
and contrast.
